Texas has NOT legalized adult-use cannabis. Its only state marijuana program is the Compassionate Use Program (CUP), a limited low-THC medical program run by the Texas Department of Public Safety (DPS), which has historically licensed only three dispensing organizations (HB 46 of 2025 authorizes additional, mostly conditional, licenses). Separately, the Texas Department of State Health Services (DSHS) runs the Consumable Hemp Program, which registers a large number of hemp/CBD businesses — a different legal regime from marijuana licensing.
